Jonathan Fozard

Jonathan is a Senior Associate in the dispute resolution team.  He joined the firm in June 2014, having previously worked at another city firm and a large regional firm.  His practice is predominantly commercial and is of a varied nature; it spans a range of disciplines, including commercial contract claims, insolvency, shareholder disputes, intellectual property, professional negligence and defamation.  He has acted for clients in a range of sectors including automobile, art, construction, financial services, private equity, real estate, defence, human resources, education, IT, leisure and entertainment, wildlife and others. He has significant experience of acting in financial services disputes, especially against banks. He is also experienced in companies court applications, advising on appeals, enforcement action and interlocutory applications, including security for costs and relief from sanctions applications (for both applicants and respondents).  He frequently acts on matters with a significant international element and has worked in collaboration with lawyers in a variety of jurisdictions including Italy, South Africa, France, Switzerland, New York, Poland, Spain, Ireland, and Sierra Leone.

  • Acting in professional negligence claims against solicitors and banks
  • Advising on an application to the High Court for ratification of a cross-border merger between a UK company and an Austrian company pursuant to the Companies (Cross-Border Mergers) Regulations 2007
  • Assisting with international arbitration proceedings (seat of arbitration: The Milan Chamber of Arbitration)
  • Acting in a wide variety of interlocutory applications (frequently on an urgent basis) including in relation to security for costs, prohibitory and mandatory injunctions, relief from sanctions and Civil Restraint Order proceedings
  • Responding to appeals / applications for permission to appeal
  • Assisting with a claim against Spanish lawyers in conspiracy, professional negligence and breach of fiduciary duty arising out of the purchase of properties in Spain
  • Applying for and obtaining an Order for Sale following a charging order
  • Acting in connection with the recovery of precious works of art
  • Acting in winding-up proceedings and bankruptcy proceedings and applying for and obtaining Validation Orders
  • Advising on intellectual property disputes
  • Advising on defamation issues and acting in connection with the removal of defamatory content from websites through the use of take-down notices under the Defamation (Operators of Websites Regulations) 2013
  • Representing clients at mediations and without prejudice meetings

Jonathan graduated from the University of Leeds with a degree in history.  He subsequently worked in marketing in the West End before retraining as a lawyer.  Jonathan completed the Graduate Diploma in Law and the Legal Practice Course (in which he achieved a distinction) at the College of Law (now the University of Law).

Jonathan is a committee member of the Junior London Solicitors Litigation Association.

Away from the office, Jonathan enjoys rugby (less playing and more watching these days), skiing, tennis, running, travelling and charity work.  He is trustee and Chairman of an international charity whose remit is to support communities in Ghana, West Africa.  He is also heavily involved with a charity established in honour of a friend lost in Afghanistan.  In 2015 he undertook a 54km cross-country ski race in Norway in aid of Parkinson’s UK, another charity which is close to his heart.  Jonathan likes to travel to new places as frequently as possible and tends to go to Brazil (where his wife is from) at least once a year.
