Trust Deeds
When a charity is first set up, it is often done so by way of a declaration of trust, which sets out the trusts upon which the charity is to operate and its property held. Trustees need to be familiar with the declaration of trust which governs their charity. We are experienced in interpreting the provisions of the declaration of trust, and advising trustees as to the objects their charity has been founded to fulfil, and how they are to operate within the terms laid down in the declarations of trust.
Often, old trust deeds inadequately set out the trusts upon which the charity is to operate, and we can advise on updating trusts by modernising provisions in trust deeds, in so far as the law allows. We can advise on the drafting of declaration of trusts for new charities and the registrations of new charities. |
